Public Notice - Proposed Lease of Nannup Bowling Green and Club House Facilities

In accordance with section 3.58(3) of the Local Government Act 1995, the Shire of Nannup advises of its intent to dispose of the following property by way of lease:

Location: Portion of Lot 31 Forrest Road, Nannup (Please refer to map below)
Reserve: Part of Reserve 3708 (Please refer to map below)
Certificate of Title: Volume 3049 Folio 774
Premises: Bowling Club Green and Clubhouse Facilities
Lessee: Nannup Bowling Club Inc.
Lease Term: 7 years with a 7 year option to extend at discretion of Council on application by the Lessee.
Annual Rent: $2,600
Rent Review: Adjusted by Consumer Price Index (CPI) Annually. Major review at the point of Term Extension Option being approved and executed
Purpose: Operation of a Lawn Bowls facility for club members including operation of associated clubhouse facilities.
Market Valuation: $3,648 per month (Valuation provided by Ray White Southwest Central)

 

Special Conditions:

1. Use by community associations and others:

  1. The Lessee shall permit community, charitable and recreational associations and bodies and such other associations, bodies or persons, to use the Clubhouse at all times when the Clubhouse is not required by the Lessee, and the Lessee shall not charge any fee for such use in excess of;

    i. $25 per hour for the function area and;

    ii. $15 per hour for the kitchen use.

    iii. Amount per above, if required, are approved to be increased by the annual Consumer Price Index (CPI).

  2. The Lessee shall take bookings by all associations, bodies and persons permitted to use the Premises pursuant to sub-Item (1) and shall enter all such bookings in a register kept for the purpose together with details of the name of the association, body or person, the hours during which the Premises were used by the association, body or person, the fees paid to the Lessee and such other details as the Lessor may require.
  3. The Lessee shall keep the register referred to in sub-Item (2) available for the Lessor to view at the Premises or forthwith upon request by the Lessor shall provide the Lessor with the register for viewing by the Lessor.

2. Provisions associated with the operation of licensed premises

  1. The Lessee shall at all times comply with the requirements of the Department of Racing, Gaming and Liquor Licence issued to the Nannup Bowling Club (Inc) (or any agency that
  2. subsequently assumes the responsibility for the issuing of licences and the compliance functions of the department). Any breach of the license provisions that are reported to the Lessor by the licensing authority may result in the termination of the lease.
  3. The Lessee is responsible for all alcohol and other contents associated with the operation of the licensed premises and should ensure they hold the appropriate insurance cover for stock and contents held on the premises at any time.

3. Rent not charged for the period of internal building foundation repairs being undertaken

  1. Rent will not be charged for the period of time that the internal building foundation repairs are completed or deemed to be unstable or unsafe by a qualified building surveyor. Once the repairs are complete or building deemed to be stable and safe by a qualified building surveyor, rent will commence as normal.

4. Building Insurance

  1. The Lessor will be responsible for maintaining an insurance policy for the building and any associated demolition costs in the event of the building being damaged by fire, flood or other similar major event.
