Liquor Licensing Requirements


If you intend to sell or supply alcohol to the public, you may require approval from the Department of Local Government, Sport and Cultural Industries (DLGSC) – Racing, Gaming and Liquor.

Liquor licensing requirements apply to businesses, organisations, and individuals supplying alcohol, including:

  • Restaurants, cafés, and taverns
  • Small bars
  • Community and sporting clubs
  • Events and temporary functions
  • Festivals and markets where alcohol is supplied

The Shire does not issue liquor licenses. However, the Shire may be required to provide approvals, comments, or certificates as part of the liquor licensing process

Section 39 Certificate - Local Government Approval

A Section 39 Certificate is a certificate issued under section 39 of the Liquor Control Act 1988 (WA) by the local government authority.

A Section 39 Certificate confirms that the proposed premises:

  • Complies with relevant local government requirements, or
  • Identifies any conditions or matters that need to be addressed before the premises can operate

A Section 39 Certificate may be required when applying for certain liquor licences, including:

  • New liquor licences
  • Changes to existing licensed premises
  • Alterations or extensions to licensed areas
  • Certain changes to the use of premises

The Shire assesses Section 39 applications to ensure the proposal is consistent with relevant requirements, including:

  • Public health requirements
  • Building requirements
  • Local laws and other relevant legislation

Public health considerations

Licensed premises must operate in a manner that protects public health and safety.

Depending on the proposal, the Shire may consider:

  • Adequacy of toilet and handwashing facilities
  • Food preparation and storage areas (where food is supplied)
  • Waste storage and disposal
  • Noise impacts and entertainment areas
  • Outdoor licensed areas
  • Patron capacity and amenity impacts

Where food is provided, separate food business notification or registration requirements may also apply.

Building approval

Building approval may be required where physical works are proposed, including:

  • Structural alterations
  • Construction of new buildings or additions
  • Changes to exits, accessibility, or fire safety systems
  • Alterations to toilets or amenities
  • Changes affecting building classification

The Shire can advise whether a building permit is required.
